Time zones are the first obstacle for videoconferencing. Time differences can be an obstacle for interstate depositions and testimony. Larger time differences can be quite a juggernaut. Creating clear communication before conference calling or video is essential.

Pay close attention when scheduling that the right time zone is being used on the calendar.

  • Schedule according to the witness’ time zone so that there is no misunderstanding. 
  • Use an electronic calendar and reminder system.
  • Set alarms to remind everyone involved of their respective coordinated times for the videoconference.

Finding a Facility to Accommodate Court-Ordered Requirements

Time differences can create logistical problems. For example:

If your client is testifying in a trial in the Middle East, say somewhere like Israel, consider the difference in time zones. From the east coast that is a seven-hour time difference. On the west coast, it’s a ten-hour difference. How do you manage that large a time gap? 

If the judge says he wants the testimony to begin at 9 a.m. on Wednesday morning in Israel, then you’ll need to have the witness connected at 2 a.m. if you’re in New York City or on the east coast.

There are two things you will need to secure for an international videoconference testimony with a large time difference: 

  1. CHECK WITH THE PRESIDING JUDGE: Figure out when the presiding judge will want the testimony.
  2. FLEXIBLE VIDEO CONFERENCE HOURS AND 24-HOUR FACILITIES: Determine a videoconference facility in the U.S. that will accommodate you at odd hours or is available 24 hours.

Technology working without a glitch is critical in video testimony in trial. Make sure that you have the right video conference equipment, top-notch technicians, and ideal connectivity. Do not cut corners. Make sure you have a backup plan—plenty of batteries, extra cords, backup connections, and lots of plan B’s. 

A few things to check and double check before videoconferencing for trial:

  1. EQUIPMENT: You’ll need to find out if the courthouse has videoconferencing equipment. Make sure you check any courthouse equipment—and have your videographer check the equipment, as well.

    If the courthouse does not have video equipment, book an experienced deposition or court videographer.

Administering the oath in an international video testimonial for trial depends on the presiding judge’s preference. In overseas depositions, the oath can often be stipulated upon agreement of both parties, but trial is different. 

  1. FIGURE OUT THE JUDGE’S REQUIREMENT for administering the oath to the remote witness.

  2. BE PREPARED to have a notary public, court reporter, or contact at the witness’s location. 

The judge will be the determining factor. They may not be satisfied with a remote court reporter administering the oath. The judge may require a notary public present with the witness to administer the oath instead. Or, they may allow the court clerk at the far site to administer the oath. 

Settle this with the judge before the testimony begins, as early as possible.
